Nursing Corporation Registration
Registration Required
Only corporations registered with the Board of Nursing, as provided in SDCL 47-11E-14, may engage in the practice of nursing.
Pursuant to SDCL 47-11E, one or more South Dakota licensed nurses may form a professional service corporation for the practice of nursing under the SD Business Corporation Act and SD Limited Liability Company Act, if in compliance with the requirements of 47-11E and ARSD 20:48:14.
Nurse License & Practice in South Dakota Required
All shareholders of the corporation must be licensed to practice nursing in South Dakota and must be actively engaged in the practice of nursing in the office of the corporation, pursuant to SDCL 47-11E-5; unless or except for illness, accident, time spent in the armed services, on vacations, or on leaves of absence that do not exceed one year.
Name of Corporation
Pursuant to SDCL 47-11E-4, the name of a nursing corporation must contain the words, professional company or professional corporation or abbreviations: Prof. Co., Prof. Corp., P.C., or PC. The name of a limited liability company must contain the words, professional limited liability company, or abbreviation, Prof. L.L.C., Prof. LLC, P.L.L.C., or PLLC. The name should also meet ethical standards.
Complete the Initial Application and submit the required documentation and fee to register a nursing corporation.
