Notice of Public Hearing to Adopt Rules

A public hearing will be held on June 5th, at 9:00 A.M. (Central) at the Springhill Suites located at 4304 West Empire Place, Sioux Falls, SD, 57106, in the Emerald Room, to consider the adoption and amendment of proposed Administrative Rules of South Dakota numbered § 20:48:03:14; § 20:48:07.01:01; § 20:48:07.01:02; § 20:48:07.01:03; § 20:48:07.01:04; § 20:48:16:04.

The effect of the rules changes in § 20:48:07.01 will be to revise the approval process for clinical enrichment programs and use of nurse preceptors. The effect of revising the rules in § 20:48:03:14 and § 20:48:16:04 will be to revise and add requirements for nurses and registrants to report to the board within 60 days a new address, name, or other reportable event. The reason for adopting the new and amended rules in § 20:48:07.01 is to update the curriculum requirements for approval of a clinical enrichment programs, add a rule to clarify preceptor requirements and allow more flexibility for use of nurse preceptors. The reason for adopting the amendment to the rule in § 20:48:03:14 is to require nurses to report address changes, name changes, and other reportable events within 60 days to be consistent with new requirements outlined in the nurse licensure compact, SDCL 36-9, and national standards, and to maintain current licensure information on file with the board. The reason to adopt a new rule in § 20:48:16:04 is to add similar reporting requirements for registered medication aides.

Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may appear in-person at the hearing, or mail or e-mail them to the South Dakota Board of Nursing, 4305 S. Louise Ave.; Suite 201; Sioux Falls, SD, 57106. Or E-mail to Linda.Young@state.sd.us. The deadline to submit any such written comments for consideration is by May 29, 2024. After the written comment period, the Board of Nursing will consider all written and oral comments it receives on the proposed rules. The Board of Nursing may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.
